What is the asbestos certificate?

It is the document required by article 21 of Catalan Law 8/2026 on the eradication of asbestos whenever a property is sold or rented out. The seller gives it to the buyer, or the landlord to the tenant.

The certificate states whether there are materials containing asbestos in the property, their condition and the risk they pose to people. We draw it up following the model of the Catalan Waste Agency (Agència de Residus de Catalunya, ARC), which is the content the law requires until the regional government approves the implementing regulation.

It is a different document from the energy certificate and the habitability certificate (cédula) and does not replace them. If you need those too, we do them in the same visit.

Who needs it

You are selling

A flat, house, commercial premises, warehouse or plot. The seller provides it and it is referred to in the deed.

You are renting out

The landlord provides it when the tenancy agreement is signed.

Built before 2002

The ARC says it applies to buildings built before 2002, when asbestos products were banned. Until the regulation is out, many notaries and agents ask for it in every transaction, so we check your case before the visit.

What we check during the visit

An engineer checks every accessible part of the property one by one and documents each item with photos. Among other things, we check:

  • Fibre-cement roofs, canopies and sheds (often called uralita)
  • Downpipes, gutters and pipework
  • Water tanks and planters
  • Flues, chimneys and ventilation ducts
  • Roller-shutter boxes and false ceilings
  • Vinyl floor tiles and their adhesives
  • Insulation on old boilers and pipes
  • Storerooms, terraces and linked parking spaces

For a flat, the certificate covers the home and its annexes, not every common area of the building, as set out in the ARC guidance.

What if asbestos is found?

Finding asbestos does not stop you selling or renting. The certificate is for information: it records where the asbestos is, its condition and the risk, and in a sale the notary has it noted in the Land Registry.

Nor does the law require you to remove it before the transaction. If any material needs confirming, we say so in the certificate and arrange the analysis with an accredited laboratory.

Asbestos certificate: frequently asked questions

Do I need an asbestos certificate to sell my flat in Salou or Tarragona?
Yes. Since 3 October 2026, article 21 of Catalan Law 8/2026 requires the seller to provide a certificate of presence or absence of asbestos in any property sale in Catalonia, including Salou, Tarragona and the rest of the province. It applies to foreign owners in exactly the same way.
Do I also need it to rent out my property?
Yes. The law requires it both for sales and for rentals. For a rental, the landlord gives it to the tenant.
How much does the asbestos certificate cost?
€150 for flats and apartments and €180 for houses, villas and townhouses, VAT included. There are no official fees on top. If a laboratory analysis is needed, it is quoted separately.
Which properties need the certificate?
According to the Catalan Waste Agency, those built before 2002, when asbestos products were banned. It covers flats, houses, premises, warehouses and plots. Until the regulation is published, part of the sector asks for it in every transaction; if you are unsure about your property, ask us.
Who can issue the asbestos certificate?
Until the regulation specifies it, a qualified building professional: an architect, building engineer or engineer, under the Spanish Building Act. At ETIK it is issued and signed by a registered industrial engineer with professional indemnity insurance.
What does the certificate include?
An inspection of every accessible part of the property, identification of any materials that may contain asbestos, their condition, a risk assessment and a photo report, following the Catalan Waste Agency model. That is what Law 8/2026 requires to sell or rent. If any material needs confirming, we arrange the analysis with an accredited laboratory.
What happens if asbestos is found in my home?
You can still sell or rent. The certificate states where the asbestos is, its condition and the risk, and in a sale it is noted in the Land Registry. The law does not require you to remove it before the transaction.
What happens if I sell or rent without an asbestos certificate?
Not providing it is a breach by the seller or landlord. According to notaries, it can lead to an administrative fine of €100 to €3,000 and problems registering the deed in the Land Registry. The notary informs both parties of these consequences.
How quickly can you deliver it?
Usually within 24 to 48 hours of the visit. If your notary appointment is very close, tell us when you book and we will prioritise it.
I live abroad. Do I need to be at the property?
No. We only need someone to give us access: a neighbour, a key holder, your estate agent or your property manager. We send you the certificate and the invoice by email and you can pay by bank transfer.
How long is it valid?
The law sets no expiry date. The certificate reflects the condition of the property on the inspection date, so it is best done close to the sale or rental.
Can you do the energy certificate and the cédula at the same time?
Yes. If you are selling or renting and also need the energy certificate or the habitability certificate (cédula), we do them in the same visit so you save trips.
